The Spanish Court of Arbitration and the Huelva Chamber of Commerce have promoted arbitration and its competitive advantages among companies in Huelva. Both institutions have highlighted arbitration as a valuable tool for companies, ideal for resolving disputes in a more efficient, specialized, and confidential manner, and as providing significant legal security.
The conference, ‘Institutional Arbitration: Confidentiality, Speed and Trust for Business’, held at the La Nao Digital Coworking in Huelva, served to highlight the possibilities offered by arbitration as an effective alternative to the judicial route and to reinforce the role of both institutions in promoting alternative mechanisms for resolving business disputes.
One of the central moments of the day was the signing of a Memorandum of Understanding for collaboration between the Huelva Chamber of Commerce and the Spanish Chamber of Commerce on arbitration, signed with the aim of strengthening cooperation between both institutions and advancing the development and promotion of arbitration as an instrument at the service of the business fabric.
Adolfo Díaz-Ambrona, Secretary General of the Spanish Chamber of Commerce and the Spanish Court of Arbitration, emphasized the role that arbitration can play in the business world. “For a company, a prolonged dispute can entail not only direct legal costs, but also the allocation of internal resources, the immobilization of funds, uncertainty in decision-making, and a potential deterioration of business relationships,” he stated. Therefore, “greater predictability regarding the procedure and its costs is an essential element for business competitiveness.”
To this end, Díaz-Ambrona stressed the need to “promote a greater culture of contract planning, help companies know when it is appropriate to resort to arbitration and encourage the inclusion of clear and properly drafted arbitration clauses.”
The Memorandum signed with the Chamber represents a further step in this direction, a collaboration that “lays the foundations” to “strengthen legal certainty, improve the management of contractual risks and help companies in Huelva to contract, invest, export and grow with greater confidence,” the Secretary General concluded.
The president of the Huelva Chamber of Commerce, Daniel Toscano, emphasized that “today we are taking a very important step towards consolidating institutional arbitration as an accessible and useful tool for our businesses. We want any business owner facing a dispute to know that alternatives to court proceedings exist and that the Chamber can offer a professional, specialized, confidential, and efficient mechanism for resolving it.”
Toscano also emphasized the collaboration with the Spanish Chamber of Commerce, noting that “the signing of this Memorandum of Understanding allows us to strengthen ties and combine capabilities. For the Huelva Chamber of Commerce, it is especially important to have the support and experience of the Spanish Chamber of Commerce and the Spanish Court of Arbitration to combine and make available to Huelva businesses the resources of both arbitration institutions, which undoubtedly strengthens and enriches this mechanism for resolving disputes that companies may encounter in the context of B2B relationships.”
The chamber president also emphasized that “trust is an essential element in any business relationship, and it is also crucial when resolving a dispute. Institutional arbitration provides precisely that trust, because the parties know they have a regulated procedure and specialized professionals to reach a solution with all the necessary guarantees.”
In this regard, Francisco Muñoz, Deputy Mayor of Huelva City Council, emphasized the importance of promoting tools that provide “security, confidence, and agility” to businesses when carrying out their activities and resolving potential disputes. The Deputy Mayor for Economy and Finance stressed that “at a time of great opportunity and economic transformation for Huelva, we need a strong, competitive, and well-prepared business sector, and for this, it is also essential that our business owners are aware of all the resources available to them.”
Muñoz also championed collaboration between public administrations and the private sector, asserting that “at the City Hall, we are very clear that business owners are key players and essential allies in Huelva’s growth. Our responsibility is to facilitate, support, and remove obstacles, always through dialogue and collaboration.” Finally, he thanked the Huelva Chamber of Commerce for “its ongoing commitment to our businesses and the city’s economic development,” emphasizing that initiatives like this event “contribute to strengthening our productive fabric and fostering a business environment based on security and trust.”
Also, during the ceremony, the members of the Higher Arbitration Council and the Arbitration Court of the Huelva Chamber of Commerce took office, thus giving a new boost to the bodies responsible for developing and strengthening the arbitration activity of the institution.
With this event, the Spanish Court of Arbitration and the Huelva Chamber of Commerce reinforce their commitment to promoting appropriate dispute resolution mechanisms and consolidate their commitment to institutional arbitration that contributes to generating greater security, confidence and agility in economic and business relations.
